Is it Relatively Easy to Predict What Will Occur in a Custody Battle?
Child custody orders include awards of physical and legal custody. The courts have wide discretion when making child custody awards and thus the results are not predictable with any degree of certainty. The courts are guided by the child’s best interest in making initial custody orders. Modification of final child custody orders generally requires a change of circumstances. Custody mediation is required before a hearing or trial may proceed.
